COMPREHENSIVE PRIVACY NOTICE FOR CLIENTS AND OWNERS

Welcome to Luna de Mar Luxury Rentals! Your privacy and the trust you place in our platform are paramount to us.


We want you to feel secure when using our services to find your dream beach house or rent your property. Therefore, we have created this Privacy Notice in clear and simple language to explain what personal data we request, why we need it, and how we protect it.


This document is prepared in compliance with Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP).


1. Who is Responsible for Protecting Your Data?
In legal terms, the "Responsible Party" is the company that decides how your data is handled.

2. What Personal Data Do We Collect?
For our platform to work and for you to rent or list a property, we require certain data. We have separated this information by user type for clarity.


a) If you are a Guest (the person renting the property):

  • Identification Data: Full name, date of birth, and a copy of your official identification (INE or passport) to verify your identity and that of the reservation holder.

  • Contact Information: Email address, landline and/or cell phone number.

  • Financial and Asset Data: Your credit or debit card information (cardholder name, card number, expiration date, and security code). Important: This information is processed directly through certified and secure payment gateways. We do not store your full card information.

  • Your Stay Information: Dates of your reservation, number of guests, and any special requests or preferences you may have.


b) If you are an Owner (listing your home):

  • Identification Information: Full name and copy of your official identification (INE or passport).

  • Contact Information: Email address, landline and/or cell phone number.

  • Tax Information: Your Federal Taxpayer Registration Number (RFC) and tax address for billing our commissions.

  • Financial and Asset Information: The Standardized Banking Code (CLABE) of your bank account to deposit your guests' payments.


c) If you only browse our website:

  • Browsing Information: Your IP address, browser type, operating system, and the pages you visit within our site. We do this through cookies to improve your experience.


Important Clarification Regarding Sensitive Data:
We do not request personal data considered sensitive by law (such as health status, racial or ethnic origin, religious beliefs, etc.). We ask that you do not share this type of information in the platform's chats or forms.


3. What Do We Use Your Personal Data For? (Purposes)
We use your data for very specific purposes. We divide them into two groups:


a) Primary Purposes (Essential for everything to work!):
These are essential to provide you with the service you expect.

  • For Guests:

    • Create and manage your account on our platform.

    • Verify your identity for everyone's security.

    • Process your reservation requests and collect payment.

    • Contact the owner of the property you wish to rent.

    • Send you your reservation confirmation and reminders.

    • Address your questions, complaints, or technical support requests.

  • For Owners:

    • Create and manage your account and your property listing.

    • Verify your identity and property ownership.

    • Manage your property reservations.

    • Deposit the earnings generated from your rentals.

    • Contact you with interested guests.

    • Issue invoices for our service fees.

b) Secondary Purposes (Those that allow us to give you an "extra"):
These are not necessary for the main service, but they help us improve and offer you things that may interest you. You can always opt out of having your data used for this purpose.


•    Send you our newsletter with promotions, discounts, and new beach destinations in Mexico.
•    Invite you to participate in satisfaction surveys to improve our platform.
•    Show you personalized advertising or recommendations based on your previous searches.


If you do not wish your data to be used for these secondary purposes, please send us an email to privacidad.lmluxury@gmail.com indicating your refusal. You have 5 business days after providing us with your data to do so, although your right to opt out remains in effect at any time.


4. Who Do We Share Your Information With? (Transfers)
In order to operate, we sometimes need to share your information with third parties. We assure you that we only do so when strictly necessary and with companies that are committed to protecting your data.

  • Between Guests and Owners: To complete the reservation, we share your name and contact information between both parties once the reservation is confirmed.

  • Payment Service Providers: We transfer your financial data to secure platforms such as Stripe, PayPal, or similar, to securely process collections and payments.

  • Government Authorities: If a competent authority (such as the SAT or a judicial authority) officially requests it from us and in accordance with the law, we will be required to share the requested information.

  • Software and Analytics Providers: We use cloud services to store information and analytics tools to understand how our site is used and improve it.


For these transfers, which are essential to provide our service, your consent is not required by law. For any other transfer that does require it, we will ask for your explicit permission.


5. Your ARCO Rights: You Are in Control of Your Data
The law grants you four fundamental rights over your information, known as ARCO Rights.

  • Access: Know what data we have about you and how we use it.

  • Rectification: Request that we correct any data that is incorrect or outdated (for example, a phone number change).

  • Cancellation: Request that we delete your data from our records when you believe it is not being used for the agreed purposes (this may involve closing your account).

  • Objection: Object to the use of your data for specific purposes (such as secondary advertising purposes).


How to exercise your rights?
It's very simple. Send a request to privacy.lmluxury@gmail.com that includes:

  1. Your full name.

  2. A copy of your official ID to prove your identity.

  3. A clear description of the right you wish to exercise and the data you wish to act on.


We will respond within 20 business days.


6. Use of Cookies and Similar Technologies
Our website uses "cookies," which are small text files that are stored in your browser. We use them for:

 

  • Essential Cookies: To ensure the site functions properly (e.g., to keep you logged in).

  • Performance and Analytics Cookies: To understand how visitors use our site so we can improve it.

Privacy Policy - the basics

Having said that, a privacy policy is a statement that discloses some or all of the ways a website collects, uses, discloses, processes, and manages the data of its visitors and customers. It usually also includes a statement regarding the website's commitment to protecting its visitors' or customers' privacy, and an explanation about the different mechanisms the website is implementing in order to protect privacy.

Different jurisdictions have different legal obligations of what must be included in a Privacy Policy. You are responsible to make sure you are following the relevant legislation to your activities and location.

What to include in the Privacy Policy

Generally speaking, a Privacy Policy often addresses these types of issues: the types of information the website is collecting and the manner in which it collects the data; an explanation about why is the website collecting these types of information; what are the website's practices on sharing the information with third parties; ways in which your visitors and customers can exercise their rights according to the relevant privacy legislation; the specific practices regarding minors' data collection; and much much more.
